By accessing or using Nichi (the application and the website at nichijiten.com, collectively the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
You must be at least 13 years of age to use the Service. By using the Service, you represent that you are at least 13 years old.
Nichi is a Japanese dictionary application available on iOS, with Android planned. The core dictionary is free and works offline. Optional paid add-ons, including voice packs and other features, are available for purchase through our website.
Nichi does not require user accounts. When you purchase an add-on, a unique Registration ID (e.g., NICHI-XXXX-XXXX-XXXX) is generated and serves as your license key. You are responsible for keeping your Registration ID secure. We are not liable for unauthorized use of your Registration ID.
All payments are processed through Stripe. Prices are displayed on the website at the time of purchase and are subject to change without notice.
All sales are final. No refunds will be issued for digital purchases, except as described below or as required by applicable law.
If you are located in the European Union, you may have a right to withdraw from a digital purchase within 14 days under EU consumer protection law. To request a withdrawal, please contact us at [email protected] within 14 days of your purchase.
If the Service is discontinued, refunds for purchases made through our website may be available as described in the "Service Discontinuation" section below.
Upon a valid purchase, we grant you a non-exclusive, non-transferable, revocable license to use the purchased add-on for personal, non-commercial use. This license is limited to the scope of the product you purchased. You may not:

All content, design, code, trademarks, and audio included in Nichi are owned by Nichi or its licensors and are protected by applicable intellectual property laws. "Nichi" and the Nichi logo are our trademarks.
Dictionary data is sourced from JMdict, which is the property of the Electronic Dictionary Research and Development Group and is used in accordance with its license.
The Service incorporates dictionary data from JMdict (used under the EDRDG license) and voice audio generated using AivisSpeech technology. The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party services.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure. Dictionary data may contain inaccuracies or errors. Audio pronunciations are AI-generated and may not perfectly reflect natural speech in all cases.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICHI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
You agree to indemnify, defend, and hold harmless Nichi and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.
We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to the Service or other users.
You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and indemnification.
We are an independent developer and cannot guarantee the indefinite availability of Nichi or its add-ons. We reserve the right to discontinue the Service, remove the application from distribution platforms (including the Apple App Store), or cease providing add-on content at any time.
In the event of a planned discontinuation, we will make reasonable efforts to provide at least 60 days advance notice via the website at nichijiten.com and/or by email if you have provided contact information.

We understand this may be disappointing if you have paid for content. We will do our best to be transparent and fair throughout any discontinuation process.
These Terms are governed by and construed in accordance with the laws of the State of Idaho, United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Idaho.
We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nichi regarding your use of the Service and supersede any prior agreements.
